Website Terms of Service
The SimpleCustomers.ai website is operated by SimpleTalk, LLC under the SimpleCustomers.ai brand. In these Terms, “SimpleCustomers,” “we,” “us,” and “our” refer to that website operator.
Agreement and eligibility
These Terms of Service (“Terms”) govern your access to and use of simplecustomers.ai, including its pages, recordings, chat features, and other content or functionality (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you use the Site on behalf of a company or another organization, you represent that you have authority to bind that organization. You must be at least 18 years old and legally able to enter into an agreement to use the Site.
Business-to-business purpose
The Site is intended for debt-settlement businesses and other business professionals evaluating customer-acquisition and live-transfer programs. It is not a consumer debt-relief application or a source of personal financial advice.
SimpleCustomers does not, through this Site, provide debt settlement, debt negotiation, credit repair, lending, legal, tax, or financial-advisory services to individual consumers.
We do not decide whether a consumer should enroll in a debt-settlement program, negotiate a consumer’s debts, or guarantee any consumer outcome. Consumers seeking help with personal debt should consult an appropriately qualified provider and should not rely on this Site as financial or legal advice.
Site information and illustrations
The Site describes our business model and potential live-transfer program features. Interface screens, call-flow demonstrations, consumer profiles, debt figures, timelines, capacity settings, campaign metrics, and other examples are illustrative unless expressly stated otherwise.
Site content is provided for general information and evaluation. It is not a binding offer, quote, commitment, promise of availability, or representation that a specific campaign configuration or result will be available to you.
Program inquiries and separate agreements
Using the chat widget, requesting pricing, emailing us, or otherwise contacting us does not by itself create a client, agency, partnership, fiduciary, or service relationship.
Any paid live-transfer campaign must be governed by a separate written campaign agreement, order form, insertion order, or similar agreement accepted by SimpleCustomers and the applicable client (a “Campaign Agreement”). The Campaign Agreement defines the services, qualification criteria, pricing, billing, measurement, operating hours, volume or capacity limits, review procedures, credits, compliance responsibilities, payment terms, and other program-specific conditions.
If these Terms conflict with a Campaign Agreement, the Campaign Agreement controls for that program.
Live transfers, consumer information, and guarantees
Unless a Campaign Agreement expressly says otherwise, information about a consumer’s debt, interests, circumstances, location, or other qualification details is supplied or confirmed by the consumer and is not independently verified by SimpleCustomers. Screening against agreed campaign criteria does not guarantee that consumer-provided information is complete, accurate, or current.
No guaranteed outcomes
SimpleCustomers does not guarantee:
- a minimum transfer volume or delivery schedule;
- that every transferred consumer will satisfy a client’s independent requirements;
- that a consumer will remain on a call for a particular duration;
- any enrollment, approval, sale, settlement, conversion rate, revenue, profitability, or other business result; or
- uninterrupted availability of a campaign, channel, supplier, or delivery route.
The 60-second billing description
The Site describes a general billing principle under which an eligible transferred call that disconnects before reaching 60 seconds is not billed. The Site description does not itself create a credit, refund, or contractual right.
The applicable Campaign Agreement controls how duration is measured, when a call is treated as connected or disconnected, eligibility, exclusions, review periods, dispute procedures, and all other billing conditions. No 60-second billing protection applies unless included in the applicable Campaign Agreement.
Transfer recordings
The Site may provide redacted example recordings for legitimate internal business evaluation. They demonstrate the nature of a live debt-settlement handoff and do not promise that future calls will follow the same script, length, content, or outcome.
Without our written permission, you may not copy, download, publish, broadcast, resell, redistribute, alter, use in advertising, include in a dataset, or use the recordings to train an artificial-intelligence or machine-learning system.
You must not attempt to identify a caller, reconstruct redacted information, contact a caller, or combine recording content with other information for re-identification. If you believe a recording contains personal or improperly disclosed information, contact support@simplecustomers.ai promptly.
Chat and communications
Information submitted through the Site must be accurate, current, and lawfully provided. If you submit information for a business, you represent that you are authorized to do so.
Do not submit consumer account numbers, Social Security numbers, financial-account credentials, medical information, or other sensitive personal information through chat, email, or another general communication channel unless we specifically request it through an appropriate channel.
By providing business contact information, you ask us to respond and permit us to contact you by email, telephone, or text as allowed by law and consistent with the disclosure presented where the information is collected. Consent to marketing is not a condition of purchase. You may opt out of marketing messages using the instructions in the communication. Inquiry-related or transactional communications may still be sent when appropriate.
Our handling of personal information is described in the Privacy Policy.
Acceptable use
You may not:
- use the Site for unlawful, fraudulent, deceptive, abusive, or infringing activity;
- misrepresent your identity, authority, affiliation, or business;
- submit information you do not have the right to provide;
- interfere with the Site, bypass security measures, probe for vulnerabilities, introduce malicious code, or disrupt another person’s access;
- scrape, harvest, or systematically extract Site content or personal information, except through ordinary search-engine indexing;
- use automated systems in a manner that burdens or damages the Site;
- access nonpublic systems, files, recordings, or accounts without authorization; or
- use Site content or recordings to identify, target, harass, or profile a consumer.
Intellectual property and third-party services
The Site and its design, software, copy, graphics, logos, trademarks, recordings, animations, interfaces, and other content are owned by or licensed to SimpleTalk, LLC and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable permission to access and use the Site for legitimate internal business evaluation. No other right is granted. “SimpleCustomers,” “SimpleCustomers.ai,” associated logos, and other brand elements may not be used without prior written permission.
The Site may rely on or link to third-party services, including chat tools, analytics providers, hosting services, and external websites. Third parties operate under their own terms and privacy practices. We do not control and are not responsible for their content, security, availability, or conduct.
If you provide suggestions or feedback, you authorize us to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
Availability, disclaimers, liability, and indemnification
We may modify, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site will be uninterrupted, error-free, secure, or compatible with every browser or device.
Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RESULTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SIMPLECUSTOMERS, SIMPLETALK, LLC, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATING TO THE SITE.
This limitation applies to Site-related claims. Liability connected with a paid campaign or service is governed by the applicable Campaign Agreement. Nothing in these Terms excludes a warranty or liability that cannot lawfully be excluded.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SimpleTalk, LLC, its affiliates, and their officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, information you submit, or infringement of another person’s rights.
Suspension, changes, general terms, and contact
We may restrict or terminate access if we reasonably believe a person has violated these Terms, created security or legal risk, or misused the Site or its content. Provisions that by their nature should survive—including ownership, disclaimer, liability, and indemnification provisions—remain in effect.
We may revise these Terms periodically. Updated Terms will appear on this page with a revised effective date. Continued use after updated Terms become effective constitutes acceptance of the revised Terms.
If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement concerning use of the public Site, but they do not replace a Campaign Agreement or another written agreement between you and SimpleTalk, LLC.
